Terms of Service

1. Acceptance of Terms

By creating an account or using CreditMend AI ("Service"), operated by CreditMend AI LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service, our Privacy Policy, and our Refund Policy.

2. Credit Repair Organizations Act (CROA) Disclosures

Pursuant to the Credit Repair Organizations Act (15 U.S.C. §1679 et seq.):

• You have the right to dispute inaccurate information on your credit report directly with credit bureaus at no cost.
• No one can legally remove accurate, timely negative information from your credit report.
• You have a 3-day right to cancel. You may cancel this contract within three (3) business days of signing without paying any fees. Cancellation must be in writing.
• You have a right to sue a credit repair organization that violates the CROA.

3. Services Provided

CreditMend AI provides AI-powered credit report analysis, dispute letter generation, certified mail delivery, and dispute progress tracking. We act as a technology platform that assists you in exercising your rights under the FCRA, FDCPA, and related laws.

4. No Upfront Fees

In compliance with CROA, we do not charge any fees before services are rendered. Your subscription billing begins only after your first service cycle (credit report analysis or dispute letter generation).

5. Subscription & Billing

Subscriptions are billed monthly. Your subscription automatically renews at the end of each billing period unless you cancel. You may cancel at any time through your account settings or by contacting support.

6. 3-Day Cancellation Right

You may cancel your subscription within three (3) business days of your initial signup for a full refund, regardless of whether services have been rendered. This is your right under CROA. After the 3-day window closes, our standard Refund Policy applies.

7. No Guarantees

We do not guarantee any specific outcome, credit score improvement, or removal of items from your credit report. Results depend on the accuracy of information being disputed and bureau/creditor responses.

8. User Responsibilities

You agree to provide accurate information, maintain the security of your account, and not use the Service for any fraudulent purpose including disputing information you know to be accurate.

9. Dispute Resolution & Arbitration

Any dispute arising out of these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be settled by binding arbitration under the rules of the American Arbitration Association in the State of Wyoming. Class action waiver applies to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, CreditMend AI LLC's total liability shall not exceed the amount you paid in subscription fees during the twelve (12) months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the Service after changes constitutes acceptance.
